LandGrant27 Feb 1705/06Samuel Duchemin had a claim for land approved for the importation of six persons into Virginia under the headright system on 27 Feb 1705/06 in Westmoreland County, Virginia, United States. The persons transported were Henry Stapleton, William Mean, William Duff, Margrett Collins, Pierce Cale and Michaell Spiller. This claim was not fulfilled until 1714.18

His name was recorded as Samuel Duchiminia. After Samuel's death, son John inherited this land, and it passed to John's widow Frances after John's death in 1739. Frances sold the land to Samuel Davis in 1740.20,21

Probable birth order based upon order named in will and estimated dates:

c 1697 - Samuel Jr.

Samuel Jr. is assumed to be the first born son since he was named after his father. A Westmoreland court judged a slave owned by Samuel Jr to be 7 yrs old on 27 Aug 1718. If we assume Samuel had to be 21 to own property, then he was born before 1697.

c 1700 - John

John is named as the eldest son in Samuel's will. Samuel Jr. is not listed and is assumed to have died, so this places John as the second born son. He was at least 21 years old when his father wrote his will in 1726, so he was born before 1705.

c 1702 - Elizabeth

Elizabeth was married at the time her father wrote his will in 1726 and is named second, so assuming she was at least 18 when married, she would have been born before 1708.

c 1704 - Anne

Anne was unmarried in 1726 when her father wrote his will and is mentioned third, and unlike sister Mary the will does not mention withholding her inheritance until she turns 18 or gets married, so she is assumed to be older than 18 in 1726 and would have been born before 1708.

1712 - James

James is mentioned fourth in the will. James' age is given as 84 or there abouts in a deposition dated 1796, so his birth year is placed at 1712. He also petitioned the Westmoreland court on 29 May 1733 for his share of his father's estate, so he must have turned 21 just before that date.

c 1714 - David

David is mentioned fifth in the will. David chose Original Brown as guardian in Feb 1729/30 when his mother Cornelia died. He was mentioned as a guardian in Sep 1733. Children could select their own guardian between ages of 14 and 21. This places birth date between 1712 and 1716.

c 1718 - Peter

Peter is mentioned sixth in the will. Peter chose brother David as his guardian in Westmoreland county on 2 Nov 1739, so he was less than 21 years old. This means he was younger than David, and was born after 1718.

c 1719 - Mary

Mary is mentioned last in the will. The will withholds her inheritance until she turns 18 or marries. Since she is unmarried in 1726 she would have been born after 1708. IF she was born after Peter she would be born after 1718.

BiographyWhile Sheriff, he used the juror room at the county courthouse as his office, which means he did not have use of the office when a jury trial was being conducted. Shortly after taking office, the state condemned the jail building and he had to make arrangements with the nearby town of Fredericksburg to house his prisoners for the remainder of the term. He initially worked alone, but was allowed to hire a part time deputy starting in 1944. He purchased a second-hand radio with $100 of his own monel and installed it in his car. During his career as Sheriff no serious crimes occurred in the county, mainly only misdemeanors and other petty crimes. He frequently pulled over speeders, and among the people he stopped were the Reverend Michaux, and famous radio evangelist from Washington, and State Senator Robert O. Lowery. He let the Reverend go with a warning, but gave the Senator a ticket.13

Horace T. Morrison, the Commonwealth Attorney for the County, was attempting to oust from office, James Samuel Dishman, the Sheriff of the County. The conflict had its origin in the desire of the Commonwealth Attorney to dominate the constitutional officers of the County and thereby attempt to have political control of the activities of the local Democratic Party Committee. All of the County Officers at that time were either elected as Democrats or were appointed with the Democratic Committee approval. The trial transcript covers the actual proceedings of the all day trial and is concluded by the written opinion of Circuit Court Judge Leon M. Bazile. The opinion of Judge Bazile adequately sets forth the result and the tone of the trial:

"None of the proof of the charges made against the Sheriff here measure up to the requirements of the law. For the most part they are frivolous and emanate from the mind of a Commonwealth's Attorney, who is a bitter enemy of the Sheriff, and who attributes corrupt or unlawful motives to any one who disagrees with him. For the good of himself and those who he has to deal with it is unfortunate that he is so constituted. For the foregoing reasons Sheriff Dishman is found not guilty of the charges made against him."36,37,38,39,40,41,42,43

Research Note

Comment by James D. Dishman on 29 Dec 2001: "The book (King George County Marriages, Vol. 1) lists William's 1st and 3rd marriage, but not the second. There is over a 10 year period that the marriage records are missing in Westmoreland County and this is the period that William would have married Jane W. Cannaday. The name Jane W. is proved by the records but the name Cannaday does not appear. I determined that she was a Cannaday from a letter written by her son and our ancestor John Dishman to his half brother William Dishman (Jr) who was then living in Washington County, Va., dated 1836 in which he made reference to "Uncle Rubin" and the records proved that there was a Reuben Cannaday. Not the best of evidence but better than none."

1797 Westmoreland County deed has William Dishman and Jane his wife selling 6 acres to Theodore Wills.

Marriage record of William Deatley and Susan (Dishman) White, 28 Jan 1858, Westmoreland, lists Susan's parents as ___ and Jane Dishman. Jane is believed to be her grandmother Jane W. Cannaday Dishman whose name was given to possibly hide the fact that her mother Lucinda Dishman was possibly unmarried at the time of Susan's birth.

Death record of son John T. Dishman (d.1866) lists parents as Wm. and J. W. Dishman.

A search of the records of Westmoreland County indicates that this most likely referred to Ruben Cannaday, so Cannaday is assumed to be Jane W.'s surname.
